Barasch & McGarry Advocates for Hundreds of Uterine and Endometrial Cancer Survivors in the 9/11 Community

Barasch & McGarry now represents four hundred 9/11 responders and survivors who have been diagnosed with uterine or endometrial cancer. All of these clients were, until 2023, excluded from the 9/11 community.

In January 2023, the World Trade Center Health Program and the 9/11 Victim Compensation Fund added uterine and endometrial cancers as covered conditions eligible for free health care and compensation, a major victory for women in the 9/11 community.

The programs had previously covered all other major types of cancer, except uterine and endometrial cancer, as well as many respiratory illnesses.

Barasch & McGarry represented the first woman to receive a 9/11 Victim Compensation Fund award for uterine cancer, a Lower Manhattan office worker.

Today, Barasch & McGarry represents nearly 250 women with uterine cancer and more than 150 women with endometrial cancer.

Partner Sara DirectorManaging Partner Michael Barasch, and other members of the Barasch & McGarry team advocated for more than a decade to convince the World Trade Center Health Program and the 9/11 Victim Compensation Fund to provide support for 9/11 responders and survivors with uterine and endometrial cancer.

The office worker who received the award “went to work every day after 9/11 because she was told the air was safe and she had to go back to work,” Sara Director said in an interview with FOX 5 New York. “She’s you. She’s me. She’s the people we see commuting on the trains in Lower Manhattan. She breathed the same air as our hero first responders.”

The health program provides comprehensive medical care to 9/11 victims for their 9/11-related illnesses.

The victim fund offers tax-free awards for pain and suffering, lost earnings, and benefits for surviving spouses and family members.

For the World Trade Center Health Program, the exposure zone consists of all of Manhattan below Houston Street and parts of Brooklyn Heights and DUMBO in Brooklyn.

For the 9/11 Victim Compensation Fund, the exposure zone includes the area of Manhattan south of Canal Street and west of Clinton Street.
